1. Agreement Overview
These Terms and Conditions apply to the Hot Tub Electrical Warranty Contract provided by the Provider to the Customer. By signing the contract, the Customer agrees to these Terms and Conditions in full.
2. Warranty Scope
The warranty is limited to electrical components listed in the contract and only applies to the hot tub specified at the time of agreement.
3. Customer Obligations
The Customer is responsible for:
– Keeping the hot tub in proper working condition.
– Maintaining appropriate water chemistry and cleanliness.
– Notifying the Provider of faults within 7 days.
– Allowing access for inspections and repairs.
4. Provider Obligations
The Provider agrees to:
– Respond to service claims within 3 business days.
– Repair or replace covered components as needed.
– Provide professional and qualified service personnel.
– Maintain public liability and product liability insurance.
5. Claim Procedure
Claims must be submitted in writing via email or post. Supporting photographs or videos may be requested. Claims can be made after 30 days from receipt of the first payment if paying monthly, or full payment of paying in full for the 12 month period, and if needed, inspection or video call.
6. Limitations of Coverage
This warranty does not cover:
– Damage due to neglect, misuse, fire, or flood.
– Cosmetic wear or accidental damage.
– Issues arising from installation errors by third parties.
– Replacement of the entire hot tub.
7. Limitation of Liability
Under no circumstances shall the Provider be liable for indirect, incidental or consequential damages. The maximum liability shall not exceed the total price paid for the warranty.
8. Cancellation
The Customer has a 14-day cooling-off period to cancel for a full refund. Cancellations after this period are non-refundable.
9. Transferability
The warranty is non-transferable unless explicitly agreed in writing by the Provider.
10. Force Majeure
The Provider shall not be held liable for delays or failure in performance caused by events beyond reasonable control, including natural disasters, government restrictions, or labour strikes.
11. Dispute Resolution
Any disputes will be handled in accordance with UK consumer law. Both parties agree to attempt amicable resolution before pursuing legal action.
12. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
